These Terms and Conditions (“Terms”) govern your access to and use of arte.bio, operated by Avant Arte B.V. (“we,” “our,” or “us”), and the services we provide (the “Services”). By creating an account or using any of our Services, you agree to these Terms. If you do not agree, you may not use our Services.
1. Eligibility
You must be at least 18 years old (or the age of legal majority in your country) to use arte.bio.
You must provide accurate and complete account information and keep it up to date.
2. Services we provide
2.1. Profiles
We provide tools that allow you to create a website or link-in-bio style page.
You are responsible for the content you upload.
You must not post or distribute content that is illegal, adult/sexually explicit, gambling-related, violent, hateful, infringing, or otherwise prohibited under our Acceptable Use Policy.
2.2. Prints
You may set up and sell prints through arte.bio.
You must not submit designs containing prohibited content (see Acceptable Use Policy).
When you list a print, you agree to the payout structure set during setup. We collect customer payments, deduct agreed production and platform fees, and pay you your share. The price is agreed with the artist during the setup of the prints and excludes shipping and framing, which are handled separately by Arte.bio.
If a print is damaged, defective, or not produced to the agreed specification due to our error, we will re-produce or replace the print.
Refunds for other reasons (e.g. change of mind) may be processed by arte.bio and deducted from payouts.
You are responsible for ensuring you have the rights to sell your works.
2.3. Mailing lists & CRM tooling
You may use arte.bio to build and contact your mailing list.
You must only email subscribers who have given valid consent.
You must not send spam, illicit, adult, gambling, harmful, or deceptive content.
You are the data controller for your mailing list subscribers. That means you choose what subscriber data you collect (names, emails, etc.), how you use it (sending newsletters, updates, promotions), and ensure it’s handled legally.
Avant Arte B.V. acts as a data processor when it stores or sends emails on your behalf. We handle the data according to your instructions but do not decide how it’s used.
2.4. Subscriptions & paid features
Some Services require a paid subscription.
Subscription fees are billed monthly or annually until cancelled.
Fees are non-refundable unless required by law.
You may cancel anytime; access continues until the end of your billing cycle.
3. Payments & fees
Payments are processed by third-party providers (e.g. Stripe).
We will pay your payout share on a monthly basis, subject to payment clearance and deductions.
We may withhold or adjust payouts for refunds, chargebacks, fraud, or errors.
You are responsible for reporting and paying taxes on your earnings.
4. Intellectual Property
You retain ownership of your content.
You grant us a limited license to host, display, and distribute your content to provide the Services.
You confirm you have all rights necessary for your content and agree to indemnify us for claims arising from it.
Our software, design, and brand remain our property.
5. Data & Privacy
Our use of personal data is described in our Privacy Policy.
You are responsible for lawful handling of any subscriber data you collect.
6. Termination
You may close your account at any time.
We may suspend or terminate your account if you breach these Terms, misuse the Services, or create legal/reputational risk for arte.bio or Avant Arte B.V.
Pending payouts will be processed subject to compliance checks.
7. Disclaimers
We provide the Services “as is” and make no guarantees about uptime, sales, or results.
Except as in Section 2.2., we are not liable for lost profits, opportunities, or indirect damages.
8. Limitation of Liability
If we damage or mis-produce prints, our liability is limited to re-producing or replacing them.
For other claims, our liability is capped at the greater of: (a) €100, or (b) the subscription fees you paid in the last 12 months.
Nothing limits liability for fraud, death, or personal injury.
9. Governing Law
These Terms are governed by the laws of the Netherlands, as Avant Arte B.V. is a Dutch entity.
Disputes will be resolved in the courts of England and Wales unless mandatory law applies.
10. Changes to Terms
We may update these Terms from time to time.
Material changes will be notified via email or in-app. Continued use means acceptance.
